Vicissitudes in the Prosecutor’s Work of Supporting State Prosecution in the Court of First Instance
The author studies various, both standard-legal and sudden, judicial situations arising during the consideration of criminal cases in the courts of first instance that make it harder for the prosecutors to ensure the further support of state prosecution. The author stresses the importance of preparatory work carried out by a public prosecutor before a court hearing, and underlines that the procedural opportunities of the prosecutor at the stage of judicial inquiry are highly limited. At the same time, the legislation offers the prosecutor a number of legal instruments whose effective implementation makes it possible to resolve conflict judicial situations in a timely manner. The author focuses on the importance of high-quality preliminary investigation and the supervision carried out by the prosecutors as part of the procedure of gathering, verifying and assessing evidence for the future objective consideration of a criminal case in court.
