Establishing Motives in the Qualification and Investigation of Extremist Crimes: Debatable Problems and Their Solutions
The authors examine the legislative characteristics of subjective features of extremist crimes in the theory of law and the practice of law enforcement. They analyze the approaches to the understanding of extremism reflected in specialized publications and normative legal acts of Russian and international legislation. They also establish the relevant law enforcement problems of criminal legislation on extremist crimes that arise when determining their motivation and the interpretation of other subjective features of extremist crimes, and demonstrate their role in the effectiveness of crime investigation. The connection between extremism and other crimes in the sphere of public safety is demonstrated, and the algorithms for their delimitation are presented.
