Criminal Procedure Aspects Of Cooperation Proceedings And Current Issues
The main purpose of the article is to study the criminal procedure aspects of cooperation proceedings, the existing problems. The issue of distinguishing the procedural form in criminal proceedings has been and remains the focus of the attention of litigators. It became more relevant in the current phase of criminal justice reforms, the goal of which is to have an efficient, economical, criminal trial that meets international standards. The new Code not only defined the idea of differentiating the criminal procedure form or pointed out the logic of the development of criminal law in this regard, but also clearly identified the expected manifestations of development in this direction in the form of simplified preliminary investigation, agreement proceedings, cooperation proceedings and private accusation proceedings. Summarizing the studies, we can note that, despite all the shortcomings, the institute of cooperation is demanded and necessary. Its provision by the new code is conditioned by extremely valid arguments. It should also be taken into account that the cooperation procedure is not intended for widespread use։ it is aimed at ensuring an effective fight against the most organized and dangerous crimes. Thus, we can state that the institution of a pre-trial agreement on cooperation is a rightfully effective tool in the fight against continuously developing crime. Its importance is significant especially in the fight against moderate, serious or especially serious organized crimes.
