DIGITAL RIGHTS IN THE SYSTEM OF OBJECTS OF CIVIL RIGHTS: PROBLEMS OF LEGAL REGULATION IN THE RUSSIAN FEDERATION
This article is devoted to a comprehensive study of current issues related to the integration of digital rights into the system of objects of civil rights of the Russian Federation. The purpose of the work is to identify and analyze the complex challenges that the emergence of digital rights poses to traditional institutions of civil law, as well as to assess the effectiveness of current legislation in regulating these relations. To achieve this goal, the following tasks were set: to define and define the essence of digital rights in the context of Russian law.; to study their place in the existing classification of objects of civil rights; to identify the main legal gaps and conflicts that arise during their regulation; and to develop scientifically sound recommendations for improving the regulatory framework. The results show that, despite the attempts of the legislator to adapt civil legislation to the new realities, the existing regulatory framework suffers from insufficient detail, fragmentation and incomplete consideration of the technological features of digital assets. The need for a deeper understanding of the legal nature of digital rights, their differentiation from other objects of civil rights and the unification of law enforcement practice is revealed. The scientific novelty of the research lies in a comprehensive analysis of the identified problems and the proposal of conceptual approaches to improving the legal regime of digital rights, which makes it possible to create a stable and predictable legal environment for the development of the digital economy. The practical significance of the work lies in the development of specific proposals that can be used by legislators and law enforcement agencies to improve the effectiveness of regulating digital relations and protecting the rights of their participants.
