CRITERIA FOR CLASSIFYING OBJECTS OF CIVIL RIGHTS AS IMMOVABLE PROPERTY: PROBLEMS OF LEGAL REGULATION IN THE RUSSIAN FEDERATION
this article examines the current problems of legal regulation of criteria for classifying objects of civil rights as immovable property in the Russian Federation. The purpose of the work is to identify and analyze the main difficulties that arise in determining the legal status of various objects in civil circulation, as well as to assess the impact of existing legal uncertainty on economic relations. The tasks include the analysis of legislative provisions, the study of judicial practice on controversial classification issues, as well as the development of recommendations for improving the regulatory framework. The obtained results demonstrate that, despite the existence of basic criteria in the Civil Code of the Russian Federation, their application in practice generates significant conflicts due to the diversity of objects of civil rights and the dynamism of socio-economic relations. Special attention is paid to the problems related to the qualification of movable and immovable property in the absence of state registration, as well as difficulties with linear objects and technological complexes. The scientific novelty of the research lies in a comprehensive analysis of the causes of legal uncertainty and the proposal of systemic measures to unify law enforcement practice. The practical significance of the work lies in the development of recommendations that can be used by the legislator to clarify the norms of civil law and law enforcement agencies to increase the stability of civil turnover.
