The Culture of Communities Adjacent to Campus: How the Law Guides the Expansion of the Physical University Campus
Abstract The expansion of the university footprint into the residential neighborhoods has been transforming the fabric of the adjoining communities into a more student-centric one. This paper provides an overview of the legal framework for land development that defines the parameters of campus expansion in the United States and the closely associated housing factors that restructure the surrounding communities. Lessons are drawn from considering recent law cases on matters relevant to the Fifth Amendment Takings Clause, eminent domain, and the enforcement of zoning regulations.
