Copyright: Concept, Problems Arising in Protection and Ways to Solution them

The need for effective copyright protection and solving problems arising from its protection are becoming increasingly urgent due to the rapid development of digital technologies, the growth of the amount of information on the Internet. Authors are increasingly faced with problems of violation of their rights, illegal use of their works, violation of license terms and difficulties in judicial protection of their rights. In addition, globalization and the development of artificial intelligence pose new challenges to the legal system, requiring updating legislation and improving copyright protection mechanisms. Problems related to the effectiveness of the copyright protection system hinder the development of creative and innovative activities. The lack of proper copyright protection leads to illegal use of works, which, in turn, hinders the development of cultural industries and creative businesses, and given the growing economic importance of creative industries, effective regulation in the field of copyright is of key importance for the development of science, art and business. This also creates barriers to international cooperation, as foreign publishers, producers and developers avoid cooperation with markets with high levels of copyright infringement. Thus, the insufficient level of copyright protection prevents Ukrainian artists, writers, musicians and developers from entering the international market, reduces the country’s attractiveness for investors in the creative economy and negatively affects Ukraine’s image as a reliable partner. In addition, an imperfect copyright protection system demotivates authors, reduces their interest in creating new works and slows down the development of innovations in the fields of art, science and technology. In this article, we propose to understand the main aspects of copyright, explore the role of this sub-branch of law in the modern legal space and the mechanisms for its protection. To analyze the main problems that arise in the implementation and protection of copyright, in particular, copyright infringement, the complexity of the evidentiary base and the insufficient legal awareness of authors. Particular attention is paid to ways to solve these problems, including improving legislation, strengthening control over copyright compliance, and raising the level of legal culture in society. Keywords: copyright, copyright protection, legal problems, protection mechanisms.
