DROIT, SOCIETE ET POLITIQUE EN AFRIQUE : DE L’IDEAL DU BIENETRE COMMUN A L’AVENEMENT DE L’INDIVIDUALISME

Abstract : The relationship between law, society and politics in Africa has evolved significantly. African societies lived around communities that prioritize common well-being over the individual. This is how the organization of traditional society was based on cultural and traditional norms with customary law and tribal systems. However, after the episod of colonization and under the influence of globalization, many African countries adopted political and legal systems inspired by Western civil and criminal law, therefore favoring the birth of individualism. Furthermore, this aspiration towards legal and political individualism will create changes in the organization of society in terms of identity and human rights. The objective of this research is to explain the concept of the ideal of common well-being and show the impact of Western modernity which is at the origin of the rise in power of individualism in an Africa once anti-individualistic. Keywords: Law, Society, Politics, Africa, Common well-being, Individualisme.
