CENSURA VERSUS REGULAÇÃO: ATÉ ONDE O ESTADO PODE INTERVIR NA LIBERDADE DE EXPRESSÃO
This article analyzes the limits of state intervention in freedom of expression, discussing the distinction between censorship and regulation. Freedom of expression is a fundamental right guaranteed by the Federal Constitution of 1988, but its practice can collide with other rights, such as honor, privacy and national security. Through a bibliographic review and analysis of emblematic cases, the study seeks to identify to what extent state regulation is legitimate and when it becomes censorship. It is concluded that regulation is necessary to protect fundamental rights, but it must be proportional and transparent, avoiding abuses that compromise democracy.
