Realization of Active Suffrage: Hidden Obstacles and Dark Side
Active suffrage is the most important mechanism for implementing the principle of democracy that serves as its foundation. In this regard, effective legal regulation of this area of relations is of particular importance for a modern state. The issues of legal consolidation of guarantees and the actual implementation of the active electoral right of citizens through the implementation of voting mechanisms at their location (“Mobile Voter”), as well as through voting for several days in a row, are considered. Based on the analysis of empirical data, as well as synthesis and induction, a comprehensive understanding of the features of the relevant legal relations has been formed. Formal legal and hermeneutic methods are used when working with the texts of legal acts. A number of legal, organizational and technical problems have been identified, which are mainly not considered in the scientific literature on the preparation and conduct of elections. It is noted that the existing procedure for submitting an application for voting at the location does not always provide the possibility of its proper implementation, and multi-day voting not only does not achieve socially useful goals, but also, under certain conditions, leads to the derogation of other rights and freedoms. Separate ways to solve the problems considered are proposed.
