FEATURES OF NOTARY LIABILITY INSURANCE IN THE EAEU COUNTRIES

The process of notary reform in Russia encourages us to turn to foreign experience in legal regulation, including in matters of notary liability insurance. An analysis of the legislation of the EAEU countries allowed us to identify two models of its implementation: 1) individual liability insurance, without the possibility of additional insurance coverage by notary associations (Kazakhstan, Kyrgyzstan); 2) mixed liability insurance based on a combination of individual and collective insurance, in which priority is given to individual insurance with the subsidiary application of collective insurance (Armenia, Belarus). Special attention is paid to the issue of taking into account the notary’s fault when making insurance payments. In order to improve Russian legislation, the author suggests focusing on the model enshrined in the legislation of the Republic of Kazakhstan.
