The pro-justice process actually cannot be applied to corporations that have mining business licenses and Current Budget Activity Plans because there must be prior legal action taken by the Ministry of Energy and Natural Resources Cq. Directorate General, namely administrative efforts in the form of Guidance and Supervision so that in this case there is an overlap of authority and rules which results in uncertainty and legal expediency. In this study using normative juridical research through research on court decisions from the first level to the final decision and from the literature. The result of this research approach is that there is a need for clear provisions to accommodate mining administration crimes specifically for companies that have mining business licenses and Current Budget Activity Plans while still paying attention to public interests, legal interests, and state interests. This is done to realize justice in mining criminal cases both in research cases and cases that may occur in the future.

Abstract

Mining Administration crimes have now occurred so much that it has become a serious concern, especially the number of companies that have mining business licenses and Current Budget Activity Plans affected by the investigation process in the Indonesian Police.
