Verifying Usulī Attributions Between al-Abiyārī and al-Ghazālī: A Comparative Analysis

This study addresses the critical scholarly value of Usul al-Fiqh (Principles of Islamic Jurisprudence) through an analytical engagement with Al-Burhān by Imam al-Juwaynī and its commentary Al-Taḥqīq wa al-Bayān by Imam al-Abiyārī. The research aims to examine the extent of Imam al-Abiyārī’s reliance on and representation of Imam al-Ghazālī’s views, identifying specific instances in Al-Taḥqīq wa al-Bayān where statements are attributed to al-Ghazālī that conflict with his authentic writings. By comparing these attributions with al-Ghazālī’s original texts, the study seeks to correct misattributions, analyze the relevant Usulī debates, and determine the strongest positions with reference to scholarly evidence and methodological rigour. Methodologically, the research involves textual cross-examination, verification of cited positions, and a comparative analysis grounded in Usulī scholarship. The study reveals that such misattributions were not unique to al-Abiyārī, as similar cases are found among other Usulī scholars. It identifies three key issues: one on which both Imams agreed, and two where al-Ghazālī upheld distinct and independent opinions. The study concludes by highlighting the jurisprudential and practical implications of these disagreements.
