SOME ISSUES OF THE FORM AND CONTENT OF THE EQUITY PARTICIPATION AGREEMENT IN CONSTRUCTION UNDER THE LEGISLATION OF THE KYRGYZ REPUBLIC
The author examines the equity participation agreement in construction from the standpoint of its legal nature and the requirements for the form and content of the agreement that are presented by the legislation of the Kyrgyz Republic, including in the area of regulating the activities of construction companies. The author analyzed individual regulations, as a result of which some gaps in the regulation of relations arising during the construction of real estate were identified. In many ways, such gaps are due to the dispersion of norms across regulations of varying legal force, as well as the lack of a unified approach to interpreting the legal nature of relations arising in connection with the payment of equity contributions to construction. The situation is aggravated by negative examples of law enforcement practice, when the concluded agreements do not guarantee the fulfillment of the obligations assumed. The author formulates the main tasks facing the legislator in the framework of the work to improve the legal regulation of the institution in question.
