On the Security Obligations of Online Live Broadcasting Platforms
The live streaming industry is developing rapidly, with a diversification in the types and operational methods of live streams. Infringement incidents occurring during live streams are also on the rise, sparking discussions among various parties about the obligations and responsibilities of live streaming platforms. The main focus is on whether the duty of safety protection applies to online live streaming platforms. Article 1198 of China’s Civil Code stipulates the duty of safety protection, but it does not explicitly specify whether this duty applies to online live streaming platforms. Moreover, there are inconsistent rulings in judicial practice. The lack of clarity in legislation, unclear scope of application, and ambiguous allocation of responsibility are areas where China’s mechanism for the duty of safety protection needs further improvement. Given the special nature of live streaming models and the need to protect the rights of live stream users, it is essential to study the duty of safety protection for online live streaming platforms.
