Band ohne Verbundenheit?
This article reconsiders the genuine link in nationality law, prompted by renewed debates over practices like golden passports. It analyses the concepts legal status in international and EU law, arguing that in the EU the link arises from the interplay of international norms, the prohibition of abuse of law, and core EU constitutional principles. The article then explores the links content, its legal effects, and enforceability – offering a framework that preserves coherence across international, EU, and national legal orders.
