Zgodność z Konstytucją RP projektu ustawy o Trybunale Konstytucyjnym (druk sejmowy nr 253)

The opinion identifies the proposed provisions of the Bill which in the author’s view do not conform to the Constitution of the Republic of Poland. These include provisions concerning: the possibility of submitting a request for the institution of disciplinary proceedings against a judge of the Tribunal by a retired judge of the Constitutional Tribunal, the possibility of appointing a person bringing disciplinary charges and judges to the bench from among retired judges of the Constitutional Tribunal, and the possibility of submitting a request for the institution of disciplinary proceedings against a judge of the Constitutional Tribunal by the President of the Republic of Poland and the Public Prosecutor-General. In other respects the Bill was assessed as conforming to the Constitution of the Republic of Poland.
