W sprawie konstytucyjności uchwały Sejmu RP z dnia 7 grudnia 2023 r. o powołaniu tzw. komisji śledczej ds. wyborów kopertowych

The Sejm’s position regarding the application of a group of Deputies to examine certain provisions of the resolution provides that Article 2 of the resolution, which defines the scope of the Sejm’s investigation entrusted to the designated investigative committee, conforms to the Constitution. According to the applicants, neither the standard conduct of a presidential election nor the typical administrative activities and lawful measures undertaken in the course of such an election may be subject to investigation by a parliamentary committee of inquiry. In the author’s opinion, this view lacks a convincing justification in light of Article 111 para.1 of the Constitution and significantly narrows the concept of a “matter” that can be addressed by a parliamentary committee of inquiry, thus constituting an excessive restriction on the Sejm’s oversight powers.
