Judicial Determination of Cyber Defamation Crimes

党的二十大报告提出：“健全网络综合治理体系，推动形成良好网络生态。”随着近年来互联网技术的成熟，当前网络架构也不断趋向精深完备，数据时代的进入，网络媒体呈现茁壮成长的趋势，网络环境变得愈发复杂，由此衍生出来相关网络违法犯罪行为发生率的提升。网络诽谤犯罪的突出特点表现为传播速度上的迅疾、传播速度快、影响范围广以及危害程度难以消除，以上特征导致了犯罪行为人的难以认定。本文通过对于网络诽谤犯罪的司法认定的现状分析，基于现有的理论，立足于司法实践，考察域外国家立法现状，进而为完善我国网络诽谤犯罪的司法认定及法律完善提供智力支持。The report of the 20th National Congress of the Communist Party of China proposed: “Improve the comprehensive Internet governance system and promote the formation of a sound Internet ecosystem.” With the maturity of Internet technology in recent years, the current network architecture is also increasingly sophisticated and complete. With the entry of the age of data, network media shows a trend of thriving, and the network environment becomes more complex, which results in an increase in the incidence of related network crimes. Network libel crime has the characteristics of fast spreading speed, a wide range of influence, and difficulty in eliminating the extent of harm. This article analyses the status quo of judicial recognition of network defamation crime, based on the existing theory, based on the judicial practice, and examines the legislative status of foreign countries, so as to provide intellectual support for improving the judicial recognition and legal improvement of network defamation crime.
