Study on Indirect Tort Liability of E-Commerce Platforms
By analyzing the evolution of the role of e-commerce platform operators, the regulatory paradigm of e-commerce platforms should be improved in due course. In terms of regulating indirect infringement on platforms, the “notice-to-delete” rule should not be too rigidly applied, and should be returned to the general framework of fault-based infringement, with the “notice-to-delete” rule as a supplementary tool. At the same time, platform autonomy should be encouraged within the existing legal framework, so as to effectively deal with the diverse forms of indirect infringement on platforms in a targeted and flexible manner.
