Review of Major Cases on Collective Building in the Second half of 2024 : Focusing on Supreme Court Precedents of Korea

In 2024, the Supreme Court has proposed a reasonable solution through various precedents and decisions regarding divisional ownership and collective buildings. In this article, I reviewed major precedents and decisions regarding collective buildings in the second half of 2024. In particular, I reviewed Supreme Court precedents and decisions that tried to establish a reasonable relationship between the Civil Code and the Collective Buildings Act. I also reviewed Supreme Court precedents and decisions that balanced the legal interests of the parties to the dispute. For example, I reviewed the Supreme Court's decision on the request for the appointment of a temporary manager of a collective building. In addition, I reviewed Supreme Court precedents on the legal theory of land use in cases where the division owner and the general land sharer have rights to the land of the collective building.
