A study on the Regualtions Concerning Disqualification of Condominium Building Managers

This study examines the disqualification system for Condominium building managers and suggests improvements. Condominium buildings, with their co-owned common areas and individually owned units, require public management to maintain communal order among multiple owners. Effective management necessitates qualified managers, ensured through a disqualification system. However, the current disqualification clauses for Management Committee members under the ACT ON OWNERSHIP AND MANAGEMENT OF CONDOMINIUM BUILDINGS Enforcement Decree potentially violate the principle of statutory reservation and are unbalanced compared to similar regulations for apartment management entities. Additionally, the lack of legal grounds for criminal record checks hinders the verification of disqualifications. Therefore, this study proposes amending the Aggregate Buildings Act to: First, Explicitly define disqualification clauses for Management Committee members and the manager in the Act. Second, Establish balanced disqualification criteria in line with those for apartment management entities. Third, Provide a legal basis for criminal record checks to ensure objective verification of disqualifications. This will enhance the transparency of aggregate building management, protect the rights and interests of unit owners, and ultimately improve the quality of community living.
