EXCLUDENTES DE ILICITUDE NO CONTEXTO DO TRIBUNAL DO JÚRI
The decision that led to the choice of the topic under study in this scientific article, which deals with the deepening of knowledge about the exclusions of illegality in the Brazilian jury courts, provided for in the general part of the Brazilian Penal Code, was based on some reasons. First, the theme, although constantly related to forensic practice, is little explored in academic research. Second, it is a right recognized and guaranteed by the national legal system, since the Penal Code provides that by acting in one of the cases listed in article 23, the subject does not commit a crime, setting the limits of action. The attention is specifically focused on the four legal causes provided for in the general part of the CP. The methodology of bibliographic compilation used in the execution of this research, aims to clarify all the objective requirements and the subjective common to all, foreseeing the excesses and exclusion of these. In this way, the main objective to be achieved here is to study about the exclusions of illegality in the context of the Jury Court. A valid legal element that, if duly proven that the illicit act was carried out without any other possibility, becomes undisputed proof of the innocence of its agent. In the end, this work only intends to be a contribution, albeit tiny, on the subject at hand.
