Key issues in planned location regulations and how to improve the related law
Korea's planned location system has been developed with the aim of efficiently utilizing land, preserving the environment, and preventing sprawl. However, in today's rapidly changing social and economic environment, the existing legal and regulatory systems related to planned location are facing limitations. Therefore, this paper critically examines the current status and problems of planned location regulations in Korea, and discusses reasonable improvement measures that can respond to social and economic changes, as well as specific strategies to improve the legal system that can be realized in legislative policy. Based on the findings of this study, we suggest the basic directions for improvement of Korea's industrial location regulation in the future: first, for new industries, it is necessary to drastically ease most of the pre-regulation, do not intervene in promotion, and focus on post-accountability-oriented regulation. When there is a conflict between the development of new industries and existing regulatory goals, it is necessary to weigh the costs and benefits of regulation based on evidence, and to hold discussions and collect opinions among stakeholders. In addition, it is necessary to establish the recently enacted Local SME Act as a system that supports the growth of local businesses through the establishment of provisions related to improving industrial location regulations in the Local SME Act. In addition, it is necessary to delegate regulatory authority to local governments and respect the diversity of regulations that reflect the unique local context.
