EFEKTIVITAS UU PERS DALAM MENJAMIN KEBEBASAN PERS DALAM MENANGGANI TINDAK PIDANA PERS: STUDI KASUS BAND SUKATANI DALAM LAGU “BAYAR, BAYAR, BAYAR” YANG BERUJUNG DIBREDEL POLISI

Abstract Press freedom is a constitutional guarantee as stipulated in Law Number 40 of 1999 on the Press. Nonetheless, this freedom is not without boundaries and may be restricted by law. This research explores the adequacy of legal safeguards for press freedom and freedom of expression through a normative juridical approach, using the case of Band Sukatani as a focal point. The case reveals a disconnect between existing legal provisions and their real-world application, exemplified by the censorship of the song "Bayar, Bayar, Bayar," which critiques misconduct by certain police officers. The study draws from statutory analysis, legal theory, and secondary sources including media coverage and legal advocacy reports. The findings suggest possible breaches of Articles 4 and 6 of the Press Law, along with infringements of Copyright Law, underscoring the urgent need for a law enforcement framework that upholds democratic and rule-of-law values. Ultimately, the study underscores the critical role of protecting both artistic and journalistic expression from arbitrary state suppression. Keywords: Press freedom, normative juridical, censorship, copyright, Band Sukatani Abstrak Kebebasan pers merupakan hak konstitusional yang dijamin oleh Undang-Undang Nomor 40 Tahun 1999 tentang Pers.
