Aspects and analyses of the security measure of confiscation of property and special confiscation
At the beginning of the century and the millennium, criminal justice finds itself in a situation that more and more authors consider to be a crisis of both the system and the means, due to the need to satisfy two requirements that are difficult to meet, on the one hand the growing need to ensure social safety and order in the face of the growing wave of crime and the violent and organized way in which it manifests itself, and on the other hand the sometimes excessive concern to ensure respect for fundamental human rights in the activity of applying and executing criminal sanctions. Special confiscation at the current stage is necessary to be applied by law enforcement agencies, together with the application of the penalty or before it, if there are grounds to confiscate the things used or intended for the commission of the crime, such a measure must be ordered by the court or the prosecutor (in certain specific cases). The application by these legal institutions of the given measure and corresponding to the crime committed, that is, having a causal connection with the committed act, will be applied only in the situation where there is a state of social danger, as a result of which the commission of new acts will be eliminated and prevented.
