On the Relationship Between Experimental Legal Regimes, Legal Experiment and Pilot Projects
In the modern period of legal development, the issues of creating effective and efficient legislation are becoming relevant. Various means are used to achieve this goal, including legislative and law enforcement agencies may resort to using an experimental method. An essential feature of the application of the experimental method in law is the temporary and limited nature of the created regulation, which makes it possible to test it in real conditions. The article examines the characteristic features of experimental legal regimes, pilot projects and legal experiments. The existing points of view regarding the correlation of these concepts are analyzed. The author notes that the problems of correlation between the experimental legal regime and the pilot project in the legal paradigm of the Russian Federation remain unresolved and poorly studied. The purpose of pilot projects and experimental legal regimes is investigated using the example of an experimental legal regime in the field of telemedicine and a pilot project for personal medical assistants. The author concludes that the experimental legal regime is a tool for the business community to test the possibility of using digital technologies in their entrepreneurial activities. The experimental legal regime creates favorable and safe conditions for testing, defining its framework in order to prevent harm. A pilot project is essentially a way to implement a management decision. Its goal is to optimize and improve the quality of existing processes. It may not always be associated with the introduction of new technologies. The legal experiment is a method of testing the possibility of establishing new legal opportunities that were not previously provided for by regulatory legal acts.
