The role of artificial intelligence in administrative proceedings in Ukraine: challenges of the digital state

This article explores the role of artificial intelligence in administrative proceedings through the lens of the influence of information technologies on the judicial system. It is emphasized that the use of digital technologies in justice offers significant advantages over the potential of a single individual or even a group of individuals. These advantages include: the creation of a repository capable of storing an unlimited number of sources (regulations, court decisions, commentaries on current legislation, etc.); the systematization of sources with the ability to automatically eliminate obsolete regulations; rapid access to databases and systematized sources, as well as the ability to search for relevant documents; acceleration of the analysis and interpretation of legal norms; the possibility of electronic document management, monitoring the course of court proceedings, automated calculations of compensation for damages; and the ability to predict decisions and verify drafts generated by software based on its analysis and evaluation of evidence, in terms of their compliance with the current legislation of Ukraine. It is noted that information technologies contribute to the debureaucratization of justice, making it more cost-effective, accessible, and efficient. Information systems are capable of comparing large volumes of data and factual circumstances of a case, ensuring a high degree of accuracy in aligning final decisions with applicable law. In this regard, the views of foreign researchers are cited, who distinguish several models of artificial intelligence: predictive (which assesses the probability of a particular event occurring), prescriptive (which determines the most appropriate actions to achieve a set goal, thus optimizing decision-making), and generative (which operates on complex data sets and is capable of generating human language and engaging in dialogue). The article concludes that the implementation of digital technologies in administrative justice entails several risks. The expansion of AI application in judicial activities should serve as an auxiliary tool for judges rather than a complete replacement. Information technologies can reveal, through analysis of large datasets of judicial decisions, issues related to the consistent application of legal norms. However, artificial intelligence cannot be held accountable for an erroneous decision subject to appeal. Responsibility for rendered decisions must rest solely with the judge.
