On some antinomys of the concept of gender equality
The article expounds the logical and philosophical foundations of the concept of gender equality. It is argued that the category of gender refers to a fundamentally different, compared to the traditional, solution to the question of the nature of man and his purpose. In man and for man, everything is declared relative and changeable, from mental and value attitudes to his bodily structure. The philosophy of gender emphasizes that man is fundamentally not his body. The latter appears as an external and alienated part of nature from man, open to his disposal and manipulation. All stable determinants of natural character are eliminated from the sphere of the human, man appears as a changeable cultural concept. Man in his gender interpretation appears as a self-legislating will, freed from natural determinants and open only to the influence of cultural and legal factors. The concept of sex becomes redundant. There is nothing natural left in man. And therefore, the natural justification for the difference between men and women is also removed. The manifestation of a person as a culturally formed unlimited will to be anyone opens the way to the universalization of this will and, oddly enough, its unification. Everyone can be anyone. The borders and boundaries between the masculine and feminine are overcome. Men and women can be localized within the framework of a single symbolic and legal space for them. Such a unifying semantic and legal space for men and women was called gender equality. However, from the point of view of its logical and philosophical characteristics, it turns out to be antinomic. At its core is an aporia - there is actually no equality between men and women, because the very basis of their demarcation is destroyed - the natural determinism of identity and purpose. Gender equality is an act of transcendence - the excess of the masculine and feminine, not their coordination, but their overcoming. Equality is the result of comparison as the action of the formal-logical law of the excluded third. However, the concept of gender equality is a manifestation of the action of another logical law - the law of identity. Equality of men and women in the sphere of law - granting them completely identical rights - becomes possible due to the fact that the philosophy of gender makes men and women identical to each other. But this identity at the point of surpassing the masculine and feminine - this is identity in a unified semantic space where everything is possible, the will is unlimited. But the limitlessness of the will, which a person proclaims, may turn out to be incompatible with freedom, meaning and any purpose. Therefore, the concept of gender equality requires a radical philosophical and legal rethinking.
