Observations on the cumulation of tort and criminal liability of sports coaches

The fundamental theoretical issues in sports law are attracting increasing interest from both theoretical and practical specialists. In this context, this article aims to analyze and clarify issues that generate conceptual, theoretical and practical difficulties. An essential point of the analysis is the civil and criminal liability of sports coaches, a topic of significant topicality and importance. In this regard, the article examines the legislation in force, highlighting the major implications in combating un law ful behavior by means of civil and, in the subsidiary, criminal law. It also raises an additional issue: whether the state can bring a civil action on behalf of a convicted person who has suffered harm as a result of a criminal act. The authors take the view that the solution depends on the nature of the criminal act giving rise to the injury. The aim of this analysis is to emphasize the need for in-depth research into the phenomenon of crime in sport, with a particular focus on the role of coaches, and to provide a basis for identifying effective solutions to prevent this phenomenon
