Settlement of disputes arising from the execution of administrative contracts in the light of CEDO decision
The assumption of the obligation to implement and harmonize Community legislation in our legal system requires that the legislation regarding the execution of administrative contracts be compliant. Disputes arising from the execution of administrative contracts should go through a preliminary procedure that must also include an attempt at an amicable settlement. Romania and the Republic of Moldova could take advantage of the Community legislation as well as the recent ECHR ruling if they started from the assumption that the theories and principles governing administrative contracts in the Union are valid, applicable and implementable. After such an approach, the legislature in Romania and the Republic of Moldova could be inspired, and could improve and harmonize the related legislation
