ANALISIS YURIDIS TENTANG JUAL BELI TANAH TANPA AJB (STUDI PUTUSAN NO. 813/PDT.G/2021/PN TNG)

The problem in this research was a land sale and purchase dispute between Panut and Ngatmo Susapto. The land that Ngatmo Susapto bought from Panut was part of a deal that didn't go through PPAT or AJB; all that was required was receipts for the sale and purchase. This prompted Ngatmo Susapto to seek legal protection for his land by having the land sale and purchase act repeated before PPAT; however, Panut had vanished and his location could not be determined. This research mostly addresses the following issues: 1. Is it permissible to purchase and sell land without an AJB in accordance with the National Land Law (Study Decision Number 813/Pdt.G/2021/PN.Tng)? Is it possible to proceed with the procedure of transferring the seller's name to the buyer (Study Decision Number 813/Pdt.G/2021/PN.Tng) without AJB? Data utilized in this study come from both primary and secondary sources, and it is descriptive and analytical in character, typical of normative legal research. Literature reviews and in-depth interviews are collected using various methods. Qualitative analysis using inference was used to conduct the research. Based on this case study, we have determined: Article 37 Paragraph (1) of PP No. 24 of 1997 states that a deed created by PPAT is necessary to show the act of sale and purchase, which the sale and purchase of Ngatmo Susapto and Panut's land does not meet with. Consequently, the National Land Law declares the sale and purchase void. 2. The Tangerang District Court's ruling remains valid and can be utilized to change the name of the land item that Ngatmo Susapto bought, according to Article 37 Paragraph (2) of PP No. 24 of 1997.
