O ESTELIONATO POR MEIO DE FRAUDE ELETRÔNICA: APONTAMENTOS DA LEI 14.155/2021 E SUA EFETIVIDADE

The advancement of technology and the increasing digitalization of interpersonal and commercial relationships have facilitated the practice of electronic fraud, making it necessary to improve criminal legislation. Therefore, this article addresses the issue of fraud committed through electronic means, with an emphasis on Law No. 14.155/2021 and its effectiveness in combating this crime. Prior to the enactment of this law, the classification of digital fraud in Brazil was generic, which hindered the effective punishment of offenders. The central question posed is: to what extent has Law No. 14.155/2021 proven effective in the fight against and repression of digital fraud in Brazil? The general objective is to understand the effectiveness of the new law in the prevention and repression of cybercrimes through criminal law. Accordingly, the following specific objectives are established: to investigate the challenges faced by criminal prosecution bodies in applying the law; and to analyze judicial decisions and relevant case law related to digital fraud after the law came into effect. To this end, a qualitative and exploratory methodology was adopted, based on a bibliographic review of legal doctrines, scientific articles, legislation, and case law related to the topic.
