RESPONSABILIZAÇÃO DE CYBERBULLYING QUANDO O AGRESSOR É CRIANÇA OU ADOLESCENTE
The socio-educational measures provided for by the Child and Adolescent Statute (ECA) are not sufficient to prevent the recurrence of cyberbullying acts committed by minors, nor to guarantee adequate justice for victims. The virtual environment, with its anonymity and the ease of spreading harmful content, presents a challenge that the conventional measures of the ECA were not created to address. Cyberbullying requires more specific and preventive responses, which take into account the particularities of this type of digital aggression. The objective of the study is to analyze the penalties that can be applied to lawbreakers and to show the damages, based on judgments and real cases of crimes on the internet. Cyberbullying causes severe and long-lasting psychological consequences in victims, often resulting in traumas that persist for years. The law provides that socio-educational measures, such as warnings or community service, may not adequately repair the damages caused, which raises questions about their effectiveness in these cases.
