The Improvement of the Notification and Consent Rule: Practice and Reflection on China’s Personal Information Protection Law

随着信息技术的发展，个人信息的保护问题日益突出，我国颁布的《个人信息保护法》为公民个人信息的保护提供了法律框架。然而，该法中的告知同意规则在实际执行中面临诸多挑战，尤其是告知形式主义、同意效力存在瑕疵、难以获得有效保护等问题。如何完善告知同意规则的建议，包括采取落实告知义务、强化同意有效基础和完善救济渠道等措施，通过研究旨在为我国个人信息保护法的实施提供理论支持和实践指导，推动个人信息保护工作向更高效和公正的方向发展。With the development of information technology, the issue of personal information protection has become increasingly prominent. The Personal Information Protection Law promulgated by China provides a legal framework for the protection of citizens’ personal information. However, the notice and consent rule in this law faces many challenges in actual implementation, especially problems such as formalism in notice, defects in the validity of consent, and difficulty in obtaining effective protection. Suggestions for improving the notice and consent rule include measures such as implementing the notice obligation, strengthening the effective basis of consent, and improving the relief channels. Through research, it aims to provide theoretical support and practical guidance for the implementation of China’s Personal Information Protection Law, and promote the development of personal information protection work towards a more efficient and fair direction.
