Obligations of Employers. Social Health Insurance Benefits
According to the law, people insured for holidays and social health insurance allowances have the right to benefit from medical leave and social health insurance allowances, based on the existence of the service relationship. The payers, respectively the employers, have the legal obligation to pay the allowances related to the medical leaves taken by their employees, subsequently covered from the budget of the National Single Health Social Insurance Fund. The article analyzes the obligations of health care unit employers to pay allowances representing medical leaves taken by their own employees, but also their tortious liability for the employees who issued medical leave certificates.
