Theoretical approaches regarding freedom of assembly

In this article we try to approach theoretically the essence of the right to assembly as a fundamental freedom guaranteed by international instruments and domestic laws. This right is also the foundation for exercising the right to freedom of expression and freedom of association. The novation of the information presented in the article refers to the aspect of the exercise of children's right to freedom of assembly. We present some possibilities regulated by law to ensure the functionality of the right to assembly for children, adolescents and young people. We found and argued the difference between the notions of law and freedom in order to avoid situations of misinterpretation of the law. Last but not least, we have presented the historical sources that led to the emergence and development of the right to assembly in the form we currently have.
