The concept of the rule of law in the European Union
In the EU's position with reference to the accession negotiations aimed at the Republic of Moldova, it is indicated that it is to fully adopt the EU acquis and ensure its full implementation and application. It incorporates the revised enlargement methodology, which provides for an even stronger focus on fundamental reforms, and our country will need to fully embrace and continue to implement reforms in the areas of the rule of law. In order for a state to become a member of the EU, it has to fulfil a multitude of conditionality and requirements, but one that is omnipresent from the very beginning as a sine-qua-non condition to initiate accession discussions and lasts throughout the integration process, namely the guarantee of the "rule of law". The rule of law in the sense of the EU acquis, as well as the requirements and conditions requested, is one of the basic pillars on which the accession negotiations will be based, and the dedication that will be demonstrated, but also the necessary consistency, will determine whether or not we have the capacity necessary to guarantee the rule of law in its EU meaning. Thus, the rule of law is one of the fundamental values of the EU which, even after the accession of the state within the Union, is a desirable thing that needs to be achieved, ensured and guaranteed without any conditions and restrictions, otherwise the member state can be held responsible through the established mechanisms through the TEU, but also at the decision-making and functional level by the EU institutions.
