K právní úpravě a využívání mediace v českém trestním právu

The article deals with the Czech legal regulation of mediation in criminal proceedings, as well as institutes, the application of which may be connected with the implementation of mediation. It also offers data on the use of mediation in practice and analyzes the reasons for the low rate of mediation use. Based on this analysis, proposals for changes and additions to the existing legislation are presented, which could contribute to more frequent and effective use of mediation. These de lege ferenda proposals concern both the procedural regulations contained in the Criminal Procedural Code (especially in connection with settlement and agreement upon guilt and punishment) and the substantive legal regulations contained in the Criminal Code regarding the imposition of punishments.
