Judicial Reform in Siberia and the Activities of Post-Reform Courts in the Irkutsk Province in the Mirror of Russian Legal Historiography

The article analyzes the peculiarities of reflection in the domestic legal historiography of the problems of Judicial reform in 1864 in the regions of Siberia. Much attention is paid to the issues of legal historiography of the activities of post–reform courts in the Irkutsk province in the late XIX – early XX centuries. The author adheres to the following periodization of the historiography of Judicial reform in the Russian Empire: prerevolutionary historiography (1864–1917); Soviet historiography (1920–1980); post-Soviet historiography (1990–2020s). The Russian pre-revolutionary legal historiography on the implementation of the Judicial Reform of 1864 in Siberia mainly includes journalistic and popular scientific works. During the Soviet period, the first scientific publications on the specifics of judicial reform in Siberia were published in the 1960s. The article concludes that, in general, this problem is very poorly represented in Soviet legal historiography. A few Soviet-era publications are also devoted to the specifics of judicial reform in certain regions of Siberia. Interest in the problems of judicial reform in Siberia and the activities of post-reform courts in this region has increased significantly in post-Soviet legal historiography. Monographic studies began to be published, in which the regional peculiarities of the implementation of Judicial reform in Western and Eastern Siberia were analyzed in sufficient depth. Many dissertations have been defended on this topic. Currently, there are very few scientific works in Russian legal historiography devoted to the activities of the prosecutor’s supervision and the institute of judicial investigators in Siberia and in the Irkutsk province, in particular. There are also no monographic studies on the formation and development of world justice in the Irkutsk province in the late XIX – early XX centuries. The formation and features of the functioning of the notary in the region have not been practically studied. Also, the historical and legal problems of the functioning of military, foreign, spiritual and other courts in the Irkutsk province and other regions of Siberia in the late XIX – early XX centuries await their researchers.
