Administrative and Legal Support for the Implementation of the Cultural Function of the State

Historically, the state and law have been in a complex and ambiguous interaction with the cultural sphere of society. The State assumes responsibility for the phenomena occurring in this area and, in this regard, introduces a cultural function into the system of its functions, among others. The author of the article concludes that in matters of legal regulation of the cultural function of the state, an important role belongs to administrative law, since it is aimed at streamlining a number of important public relations in various spheres of public administration, determines the procedure for the implementation by relevant subjects of certain functions of the state, including cultural functions. The issues of interaction between the state and law with culture as an essential sphere of social life are becoming more and more relevant and, moreover, need detailed study and solution. In particular, it seems advisable to begin a theoretical study and improvement of the regulation of the implementation of the cultural function by the state from the terminological apparatus on selected topics. Thus, the author considers the problems of rethinking the content of the term “public administration” and some aspects of its relationship with other categories, such as “state regulation” and “public administration”. In the course of the study, the author comes to the conclusion that today it is more appropriate to talk not about public administration (regulation) in the fi eld of culture, but about administrative and legal support for the implementation of the cultural function of the state. The introduction of the term “administrative and legal support for the implementation of the cultural function of the state” instead of the terms “state management of culture” or “state regulation of culture” will contribute to a more correct reflection of political and social reality in legal norms.
