Kurator ustanawiany przez sąd dla dłużnika w postępowaniu egzekucyjnym na podstawie art. 818(1) k.p.c.

The author presents the purpose and motives for the introduction of the institution of a conservator appointed on the basis of Art. 818(1) of the Civil Procedure Code by an enforcement court for a debtor being a business unit in connection with gaps in that business unit’s authorities. The author discusses premises for the appointment of a conservator that are stipulated by law and distinguishes the operating area of an enforcement court and a bailiff. The author points out that there are no regulations which clearly define competences of a conservator appointed on the basis of Art. 818(1) of the Civil Procedure Code and that the legislator completely omits the co-existence of a conservator with conservators appointed on other legal basis, including in particular a conservator appointed on the basis of Art. 42 of the Civil Code. Keywords: guardian, business unit being a debtor, enforcement court, protection of the debtor’s interests, bailiff, conservator’s powers, loss of a representation authority, gap in authorities, bailiff refraining from further enforcement activities

Abstract

The author presents the purpose and motives for the introduction of the institution of a conservator appointed on the basis of Art. 818(1) of the Civil Procedure Code by an enforcement court for a debtor being a business unit in connection with gaps in that business unit’s authorities.
