Freedom of Women in the Context of Societal Interests and Morality

This paper explores the complex relationship between women's freedom, societal interests, and morality.Despite constitutional and international legal recognition of women's rights, entrenched social norms and moral codes often restrict women's autonomy.Using a doctrinal research method, the study examines legal frameworks, landmark judicial decisions, and international instruments to analyze how societal morality and collective interests shape, limit, or justify women's freedoms.Findings reveal that while constitutional morality upholds values of justice, equality, and individual liberty, societal morality-often rooted in patriarchal traditions-continues to influence women's roles in family, work, and public life.Judicial interventions in India have progressively upheld women's rights, particularly in areas like reproductive autonomy, marriage, employment, and protection from violence. The paper concludes that safeguarding women's freedom requires prioritizing constitutional morality, reforming outdated social norms, and adopting a holistic approach involving legal reform, social awareness, and inclusive policy measures to achieve genuine gender equality.
