PROTEÇÃO DE DADOS E PRIVACIDADE NA ERA DA INTELIGÊNCIA ARTIFICIAL: DESAFIOS NORMATIVOS NO TRATAMENTO DE DADOS PESSOAIS POR SISTEMAS DE IA SOB A PERSPECTIVA DA LGPD

This article analyzes the legal challenges related to personal data protection in the context of the growing implementation of artificial intelligence (AI) systems in Brazil. The research investigates how the General Data Protection Law (LGPD - Law No. 13,709/2018) has been applied in face of new technological paradigms and evaluates its adequacy to the specific risks presented by AI systems. Through a legal-dogmatic approach and analysis of concrete cases of data processing by intelligent systems, the study identifies regulatory gaps and proposes guidelines for adapting the Brazilian legal framework. The results reveal that, although the LGPD establishes fundamental principles applicable to data processing by AI, significant challenges remain regarding algorithmic transparency, accountability for automated decisions, and the right to explanation. The conclusion points to the need for specific complementary regulations for AI that can coexist harmoniously with the LGPD framework, ensuring both technological innovation and effective protection of data subjects' fundamental rights.
