A PARADOXAL RELAÇÃO DO TRABALHO DECENTE E A INDUSTRIA 4.0: UM OLHAR SOBRE A (DES) REGULARIZAÇÃO DO TRABALHO INFANTIL NAS REDES SOCIAIS

This study analyzes the paradoxical relationship between Industry 4.0 and the concept of decent work, focusing on the participation of minors as digital influencers on social media. The research investigates the impacts of the Fourth Industrial Revolution on the regulation of child labor in digital environments, in light of the principles established by the International Labour Organization (ILO). The main objective is to understand how technological advancements affect the protection of childhood and the guarantee of dignified working conditions. Specific objectives include: discussing the foundations of decent work; analyzing the effects of Industry 4.0 technologies on labor relations; examining the legal treatment of child influencers in Brazil; and identifying regulatory gaps that allow for child exploitation under the guise of digital content creation. A qualitative methodology is adopted, based on bibliographic review and documentary analysis of legislation, case law, academic articles, and international documents. The results indicate that although Industry 4.0 brings significant innovations, it also introduces new challenges to the enforcement of labor rights, especially concerning the protection of children and adolescents. The participation of minors on social media occurs in a legal gray area, enabling forms of exploitation that do not clearly fall under existing legal definitions. The study concludes that emerging technologies can support the promotion of decent work, provided they are accompanied by specific regulations, effective oversight, and cooperation between the State, companies, and civil society. The research highlights the urgent need for updated legal frameworks to ensure the comprehensive protection of children and adolescents while respecting their rights to expression and creative development.
