A REGULAÇÃO DA SAÚDE SUPLEMENTAR NO BRASIL E A JUDICIALIZAÇÃO EM RONDÔNIA
This paper analyzes the limits established by law for state intervention in the supplementary health sector in Brazil, based on the regulatory actions of the National Supplementary Health Agency (ANS), considering the repercussions of judicialization in Rondônia. The research addresses the historical context in which state regulation took place in the country and begins with the economic understanding of regulation as a state mechanism to correct market failures, especially due to information asymmetry. The institutional difficulties faced by ANS are also assessed, such as political influence and slowness in responding to social demands and the high level of judicialization in the sector. The evolution as a regulatory agency and its quest to promote quality of care are discussed, as well as the impacts of the judicialization of health on regulatory effectiveness. Finally, the research analyzes the recent impacts of legislative and regulatory changes in the sector and the challenges to strengthen social trust in regulation.
