OBSOLESCÊNCIA PROGRAMADA: UMA DEFICIÊNCIA DO CÓDIGO DO cONSUMIDOR BRASILEIRO
This paper aims to analyze the practice of planned obsolescence from the perspective of Consumer Law, focusing on its prohibition as a means of protecting trust in consumer relationships. Planned obsolescence refers to the deliberate practice of reducing the lifespan of products to encourage continuous consumption and the accelerated disposal of still functional goods. It is a business strategy that directly challenges sustainability principles and basic consumer rights, such as information, transparency, and objective good faith. The research was conducted through a bibliographic, documentary, and normative review, with a qualitative and descriptive approach. The study highlights the need for increased oversight and specific regulation to curb abusive practices and ensure the effectiveness of the Consumer Protection Code. It concludes that prohibiting planned obsolescence is crucial for balancing consumer relations and promoting a more fair and ethical market.
