O DIREITO FUNDAMENTAL À PROTEÇÃO DE DADOS PESSOAIS NO BRASIL: DESAFIOS E PERSPECTIVAS PARA A EFETIVAÇÃO DA LGPD
This article analyzes the fundamental right to the protection of personal data in Brazil, with emphasis on the challenges of implementation and the prospects for the effective enforcement of the General Data Protection Law (LGPD). Focusing on fundamental rights and the role of the State in ensuring privacy and informational self-determination, the study examines the national and international legal frameworks, the main barriers faced by data subjects and data controllers, as well as proposals to strengthen the data protection culture in the country. The study shows that, although the LGPD represents a significant normative advance, its full effectiveness depends on technical training, institutional cooperation, social awareness, and the development of integrated public policies. It is concluded that consolidating data protection as a fundamental right requires continuous efforts to overcome information inequalities, strengthen oversight mechanisms, and promote the participation of data subjects in the governance of their data.
