A Study of the Thought of Rule of Law in Ancient China—Taking the Thoughts of Rule of Law of Shang Yang and Han Fei as Examples

中国古代法治思想源远流长，有许多著名的法家代表人物。其中以商鞅和韩非为翘楚。商鞅主持了秦国的“商鞅变法”。商鞅首先解决了变法的理论支撑问题，而后阐述了变法的具体措施。韩非是中国古代法家思想的集大成者，他综合多家，形成了法、术、势相结合的思想体系。韩非思想的基本特点就是要坚决而全面地推行法治。他们的法治思想发挥着规范社会秩序的作用，对今天中国的法治建设也有一定借鉴作用。The thought of rule of law in ancient China has a long history, with many renowned representatives. Among them, Shang Yang and Han Fei stand out. Shang Yang presided over the “Reforms of Shang Yang” in the State of Qin. He first addressed the theoretical support for the reforms and then expounded on the specific measures. Han Fei was the grand master of legalist thought in ancient China. He integrated various schools of thought and formed a system that combined law, strategy, and power. The fundamental characteristic of Han Fei’s thought was to resolutely and comprehensively implement the rule of law. Their thoughts of rule of law played a role in regulating social order and still have certain reference value for China’s current rule of law construction.
