The reformation of the notary of Ukraine in the context of European integration

The article analyzes the key directions of reforming Ukraine’s notarial system proposed by the Notary Chamber of Ukraine, which take into account the European integration policy of the state. In particular, the author examines the issues of the introduction of an electronic notary system, the transition to a unified notarial system, the expansion of notarial powers, and the self-regulation of the notary profession. The author analyzes both the prospects for the implementation of each of these measures and the potential challenges that may be faced by government agencies, the notary community, and Ukrainian society. The study of international experience in the organizational and legal support of notarial activities, particularly the models operating in the countries of the European Union (hereinafter - EU) and the International Union of Latin Notaries, makes it possible to assess the compliance of the planned changes with European standards and the principles of Latin notaries. In addition, such measures align with the common values enshrined in the Association Agreement between Ukraine, on the one hand, and the European Union, the European Atomic Energy Community, and their Member States, on the other hand (hereinafter - the Association Agreement). Special attention is paid to the reforms already implemented, particularly to the creation of the Unified State Electronic Notary System, the components of which are gradually being integrated into notarial practice. The article also highlights the main problematic aspects of notarial activity in Ukraine that need to be addressed within the framework of the proposed reform. These include the absence of a single codified act, fragmentary amendments to the Law of Ukraine “On Notaries,” the low level of digital literacy among notaries and citizens, cybersecurity risks, and the financing of state notary offices from the budget. The author emphasizes the need to ensure the security of data for users of the electronic notary system and to prevent unauthorized interference. In addition, the article presents an analysis of statistical data on the activities of public notary offices and private notaries in Ukraine, which allows assessing the effectiveness of their operation and the feasibility of introducing a unified notarial system. This approach contributes to a comprehensive coverage of the topic and determines its prospects in the context of European integration.
